1. Acceptance of Terms
By accessing or using PulseQRC (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, users, and account holders.
2. Description of Service
PulseQRC is a real-time QR code-based feedback platform that allows businesses to collect anonymous customer feedback, receive instant alerts, and manage their reputation through a centralized dashboard.
3. Account Registration
- You must provide a valid email address to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 18 years old or the age of majority in your jurisdiction.
- One person or legal entity may not maintain more than one free account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Submit fake, deceptive, or spam feedback through QR codes
- Attempt to gain unauthorized access to other accounts or systems
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated scripts or bots to interact with the Service
5. Subscription & Billing
- All plans include a free trial period as advertised at the time of signup.
- After the trial, your selected plan will automatically renew at the stated price unless cancelled.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Refunds are not provided for partial billing periods.
- We reserve the right to change pricing with 30 days’ notice to existing subscribers.
6. Data Ownership
You retain ownership of all feedback data collected through your QR codes. We do not claim any intellectual property rights over your content. You grant PulseQRC a license to store, process, and display your data solely for the purpose of providing the Service.
7. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.
8. Limitation of Liability
To the maximum extent permitted by law, PulseQRC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your account if you violate these terms or engage in activity that harms the Service or other users. Upon termination, your right to use the Service ceases immediately. Your data will be retained for 30 days following termination, after which it will be permanently deleted.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Hennepin County, Minnesota.
11. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated to account holders via email at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated terms.
